The fight over Fulton County 2020 ballots took a major turn on Thursday after a federal judge refused to order the FBI to return voting materials seized earlier this year. The decision allows the Justice Department to push forward with its renewed investigation into how Georgia counted votes in the 2020 presidential election, a contest President Donald Trump narrowly lost to Joe Biden.

Judge Calls Some FBI Claims “Troubling” but Rules in Favor of Investigators

U.S. District Judge J.P. Boulee, who was appointed by President Trump, issued the ruling after reviewing concerns raised by Fulton County officials. While the judge admitted that certain portions of the FBI’s sworn affidavit used to secure the search warrant were “troubling,” he ultimately decided that local officials had failed to demonstrate that their rights had been ignored or violated.

The county had pushed back hard against the seizure of more than 600 boxes of election materials, including original paper ballots. They argued the warrant was flawed and that the search was conducted improperly. Boulee, however, found neither argument convincing enough to justify returning the materials.

The judge also dismissed worries that the continued FBI custody of these ballots could undermine public trust in locally managed elections. He did not see that concern as sufficient grounds to override the federal investigation.

A Long Shadow Over the 2020 Election

President Trump lost Georgia in 2020 by roughly 12,000 votes and has never moved past that defeat. He has continued to promote unverified claims of widespread voter fraud and has pushed for more federal authority over how states run elections.

Yet the facts on the ground tell a different story. Multiple audits, nearly a dozen court rulings, and even William P. Barr, who served as Trump’s own attorney general, have all concluded that there was no evidence of fraud or errors big enough to change the outcome of the Georgia race.

Despite that long record, the Justice Department has reopened its focus on the 2020 results, drawing sharp criticism from election officials, voting rights groups, and democracy advocates nationwide.

The January FBI Raid That Started the Storm

The current legal fight traces back to January, when FBI agents seized Fulton County’s voting records, including every ballot cast in 2020. The raid sent shockwaves through election circles, with many officials calling it an unprecedented intrusion into local election administration.

Within days of the seizure, Fulton County officials filed a lawsuit demanding the return of the materials. They claimed that investigators had misled an Atlanta-area federal magistrate judge in order to obtain the warrant that authorized the search. The Justice Department has not stopped at Georgia. In recent months, it has also opened a new inquiry into Arizona’s 2020 election results, signaling a broader effort to revisit battleground state outcomes from six years ago.

Trump’s Push for Federal Control Over Elections

Alongside these investigations, Trump has continued to call on Republican lawmakers to take dramatic steps to centralize election rules across the country. His list of demands includes:

  • Establishing nationwide voter identification requirements
  • Banning the use of electronic voting machines
  • Eliminating mail-in voting in all states

These proposals would represent some of the most sweeping changes to American election administration in modern history. Voting rights advocates warn such measures could disenfranchise millions of voters, while supporters argue they are necessary to restore confidence in the system.

Broader Concerns Among Election Officials

The reaction to the FBI’s seizure has been intense. Election officials in both parties have voiced concern that the federal government’s actions could set a dangerous precedent, opening the door to future seizures of ballots and election records based on political motivations rather than concrete evidence.

Democracy advocates have echoed those worries, noting that revisiting the 2020 outcome six years later sends a troubling signal about how future elections might be treated. They argue that public trust in elections depends on respecting verified results, not endlessly relitigating them.
